| Regulations for the reservation and distribution of free online tickets for events of the Warsaw Ghetto Museum

§ 1

General provisions

  1. These Regulations define the rules for booking, collecting and using free tickets for events organized by the Warsaw Ghetto Museum, hereinafter referred to as the "Museum".
  2. The event organiser and operator of the booking system is the Warsaw Ghetto Museum based in Warsaw, entered into the Register of Cultural Institutions maintained by the Minister of Culture and National Heritage, number RIK/109/2018.
  3. Free tickets are booked via the online booking system available on the Museum's website.
  4. The operator of the reservation system is SoftCOM Sp. z o. o. (KRS: 0000033037, NIP: 5832104480), the supplier of the iKSORIS system.
  5. Using the reservation system means that you have read and accepted these Regulations.

§ 2

definitions

  1. Museum – Warsaw Ghetto Museum.
  2. System – iKSORIS online ticket booking system provided by the Museum.
  3. User – a person booking a free ticket via the System.
  4. Ticket – electronic confirmation of a reservation for an event organized by the Museum.
  5. Event – a meeting, lecture, workshop, walk, screening, debate, concert or other cultural, educational or scientific event organised by the Museum.

§ 3

Technical requirements

  1. Using the System requires:
    1. devices with Internet access,
    2. an up-to-date web browser that supports cookies and JavaScript,
    3. active e-mail address.
  2. The Museum is not responsible for any disruptions in the functioning of the System resulting from:
    1. force majeure,
    2. Internet network failure,
    3. technical problems on the User's side,
    4. actions of third parties,
    5. actions or omissions of entities through which the Museum provides the service.
  3. The Museum reserves the right to temporarily suspend the operation of the System for technical or organizational reasons.
  4. The Museum will exercise due diligence to ensure the continuity of the System's operation and minimize interruptions in its availability.

§ 4

Ticket booking rules

  1. To book a free ticket, please use:
    1. event selection,
    2. selection of the number of available seats,
    3. providing the required data,
    4. confirmation of reservation.
  2. The number of places for individual events is limited.
  3. The reservation is effectively made when the User receives an e-mail containing the ticket or booking confirmation.
  4. The ticket is issued in electronic form.
  5. The Museum may specify a maximum number of tickets per User.
  6. The Museum reserves the right to cancel reservations made:
    1. using false data,
    2. repeatedly by the same person in violation of the limits set for a given event,
    3. in a way that indicates automatic or unauthorized acquisition of places.

§ 5

Using tickets

  1. The ticket entitles you to one-time participation in the event indicated on the ticket.
  2. The user is obliged to present the ticket:
    1. in electronic form or
    2. in print form,
      if the organisation of a given event requires it.
  3. Minors may participate in events organized by the Museum under the supervision of an adult participating in the event with them, unless the rules of a given event provide otherwise.
  4. A place for a minor may be booked by his or her legal representative, legal guardian or the minor himself or herself, if the nature of the event and applicable law allow it.
  5. In the case of minors under 13 years of age, the reservation is made by their legal representative or guardian.
  6. The Museum may refuse participation in an event to a person:
    1. without a valid ticket,
    2. is visibly under the influence of alcohol, narcotics, psychoactive substances or other similar substances,
    3. possessing weapons or other dangerous items, explosives, pyrotechnic products, fire-hazardous materials, alcoholic beverages, narcotics or psychoactive substances,
    4. behaving aggressively, provocatively or otherwise posing a threat to public safety or order.
    5. not meeting the participation conditions specified for the event,
    6. violating the provisions of generally applicable legal provisions or provisions of regulations or other rules of conduct in force at the place where the event is organised;
    7. a minor without the supervision of a required adult guardian.
  7. Any unused ticket expires after the event ends.

§ 6

Event cancellation, withdrawal from participation and cancellation of reservation

  1. In the event of cancellation of participation in the event, the User should immediately cancel the reservation by informing the Museum by sending an e-mail to bilety@1943.pl.
  2. The Museum may cancel a reservation if necessary for organizational, technical or safety reasons.
  3. In the event of an event cancellation or change, the Museum will notify Users via the email address provided during the booking process. If a new date is set for the event, the Ticket remains valid.
  4. Since participation in the events is free of charge, cancellation of the reservation will not result in any financial consequences for either Party.
  5. The Museum reserves the right to:
    1. event cancellation,
    2. change of event date,
    3. changes in the event location,
    4. changes to the event program
      for reasons beyond the Museum's control or resulting from the organisation of the event.
  6. Information about changes will be communicated to Users via e-mail and, if possible, published on the Museum's website.

§ 7

Claims

    1. Complaints regarding the operation of the System or the booking process can be submitted:
      • via e-mail to the following address: bilety@1943.pl,
      • in writing to the address of the Museum's registered office.
    2. The complaint should include:
      1. name and surname of the reporting person,
      2. e-mail address used for booking,
      3. description of the problem,
      4. date of the event.
    3. Complaints will be considered within 14 days of their receipt.
    4. Failure by the Museum to respond within 14 days from the date of filing the complaint will mean that the complaint has been accepted by the Museum.
    5. If the complaint is deemed justified, the Museum may, among other things, grant the User a Ticket for another event, subject to availability of seats.

§ 8

Use of Personal data

    1. The Controller of your personal data is the Warsaw Ghetto Museum, with its registered office at 39 Zielna Street, 00-108 Warsaw. You can contact the Controller: in writing, at the registered office address, by telephone: +48 22 419 92 50, or by email: muzeum@1943.pl.
    2. The Administrator has appointed a Data Protection Officer who can be contacted in matters related to the processing of personal data: in writing, to the Administrator's registered office address, by e-mail: iod@1943.pl.
    3. Your personal data will be processed for the following purposes: event reservations, communication related to event organization, complaint handling, and pursuing or defending against potential claims. Based on:
      1. Article 6 paragraph 1 letter b GDPR – processing is necessary to make a reservation.
      2. Article 6 paragraph 1 letter c of the GDPR – processing is necessary to fulfil the legal obligation incumbent on the controller resulting from the provisions on the activities of cultural institutions and the maintenance of organisational and reporting documentation.
      3. Article 6 section 1 letter a of the GDPR – in the case of expressing separate, voluntary consent to receive information about the Museum's events and offers (newsletter) in connection with Article 398 of the Act of 12 July 2024 – Electronic Communications Law.
      4. Article 6 paragraph 1 letter f of the GDPR – which constitutes the legitimate interest of the Controller, consisting in the possible establishment, pursuit or defense against claims
    4. Personal data will be processed until the event ends. After that time, they may be stored for the period required by regulations on archiving documentation of public institutions' activities. In the case of data processed based on consent (newsletter), they will be processed until the consent is withdrawn or the data becomes obsolete. For the purposes of establishing, pursuing, or defending against legal claims, data will be stored until the statute of limitations for such claims expires.
    5. Providing data is voluntary, but necessary to make a reservation for an event.
    6. The recipients of your data may be: entities authorized under the law, entities providing organizational, technical and IT services to the Controller, e.g. event management system providers, companies supporting the organization of events.
    7. Personal data will not be transferred to third countries or international organizations.
    8. In connection with the processing of personal data, you have the following rights:
      1. the right to access your data and receive a copy thereof (Article 15 of the GDPR),
      2. the right to request rectification of data (Article 16 of the GDPR),
      3. the right to request the deletion of data ("the right to be forgotten") – in the cases specified in Article 17 of the GDPR,
      4. the right to request restriction of data processing (Article 18 of the GDPR),
      5. the right to data portability (Article 20 of the GDPR),
      6. the right to object to data processing – only where processing is based on Article 6(1)(e) or (f) of the GDPR (Article 21 of the GDPR). The right to object does not apply where data are processed on the basis of Article 6(1)(b) or (c) of the GDPR.
      7. the right to withdraw consent at any time (in relation to data processed on the basis of Article 6(1)(a) of the GDPR, e.g. for the purpose of sending the newsletter), without affecting the lawfulness of processing based on consent before its withdrawal.
    9. If you believe that the processing of your personal data violates the provisions of the GDPR, you have the right to lodge a complaint with the President of the Personal Data Protection Office.
    10. Your personal data will not be subject to automated decision-making, including profiling, referred to in Article 22 of the GDPR.

§ 9

Miscellaneous

  1. The regulations are available on the Museum's website.
  2. The Museum reserves the right to change the Regulations.
  3. Changes to the Regulations do not affect reservations made before their entry into force.
  4. In matters not regulated by the Regulations, the provisions of Polish law shall apply, in particular:
    1. Civil Code,
    2. Act of 18 July 2002 on the provision of services by electronic means,
    3. Act of 12 July 2024 – Electronic Communications Law
    4. Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
  5. The Regulations come into force on the date of their publication.
